General

1.1 What are personal data

Personal data are details that disclose or can disclose the identity of the user. We adhere to the principle of data avoidance. Wherever possible, we refrain from collecting personal data.

1.2 Handling of personal data

Personal data are used exclusively for the establishment, design, execution, or processing of the contractual relationship (Art. 6 I S. 1 b GDPR).

Furthermore, personal data are only processed if we have obtained your consent (Art. 6 I S. 1 a GDPR) or if it concerns data whose processing is necessary for our legitimate interests, and the balancing shows that no overriding interests, fundamental rights, or freedoms on your part oppose it (Art. 6 I S. 1 f GDPR).

We may use data processors to process your personal data, but generally, personal data will not be disclosed to third parties.

For payment processing, the necessary payment data will be passed on to the credit institution responsible for the payment and, if applicable, the commissioned and selected payment service provider.

The processing of your personal data takes place exclusively within the EU, unless something different is explained below.

1.3 Usage data

When visiting the website or using the app, general technical information is collected. This includes the IP address used, time, duration of the visit, browser type/device type, and possibly the origin page. This usage data is technically recorded in a log file and can be used and stored for the purpose of statistical analysis. These usage data are not linked to your other personal data.

1.4 Registration data (Effeqtiv Motion Mobile App)

Registration is required for the comprehensive use of our app's features. Registration data is collected through your corresponding entries and used for the specific purpose stated in accordance with your consent (Art. 6 I a GDPR).

To use our app, you must also register in the Google Play Store or Apple App Store to download the app. The separate provisions of Google or Apple apply here.

1.5 Data access

With your consent, we have access to the following types of data:

  • End device

  • Type of end device

  • Time zone

  • Country of origin

  • Photos/media/data (if activated)

  • GPS data (if activated)

  • This data is needed for user identification and the functions of our app. However, it is also intended to prevent abusive use by the user.

2. Your Rights

2.1 Information

You can request information from us about whether we process personal data about you, and if so, you have the right to information about this personal data and the further information mentioned in Art. 15 GDPR.

2.2 Right to rectification

You have the right to correction of your inaccurate personal data and, in accordance with Art. 16 GDPR, you can request the completion of incomplete personal data.

2.3 Right to erasure

You have the right to demand that we immediately delete the personal data concerning you. We are obliged to delete them immediately, especially if one of the following reasons applies:

Your personal data are no longer necessary for the purposes for which they were collected or otherwise processed.

You revoke your consent on which the processing of your data is based, and there is no other legal basis for the processing.

Your data has been processed unlawfully.

The right to erasure does not exist if your personal data are necessary for the assertion, exercise, or defense of our legal claims.

2.4 Right to restriction of processing

You have the right to request us to restrict the processing of your personal data if: You dispute the accuracy of the data, and we therefore check the accuracy.

The processing is unlawful, and you reject deletion and instead request restriction of use. We no longer need the data, but you need it to assert, exercise, or defend legal claims. You have objected to the processing of your data, and it is not yet clear whether our legitimate reasons outweigh your reasons.

2.5 Right to data portability

You have the right to receive the personal data concerning you that you have provided to us in a structured, common, and machine-readable format, and you have the right to transfer this data to another responsible party without hindrance from us if the processing is based on consent or a contract and the processing is carried out using automated procedures.

2.6 Right to withdraw consent

If the processing of your personal data is based on consent, you have the right to withdraw this consent at any time.

2.7 General and right to lodge a complaint

The exercise of your aforementioned rights is generally free of charge for you. You have the right to complain directly to the competent supervisory authority, the state data protection officer, in the event of complaints.

3. Data security

All data on our website and within our app is secured against loss, destruction, access, modification, and distribution by technical and organizational measures.

We use the following social media platforms for company presentation and communication (the linked privacy policies and opt-out options are explicitly referred to below):

These social media platforms may process personal data outside the EU; in this regard, we refer to the above privacy policies of the social media platforms. The respective social media platforms may create usage profiles based on your usage behavior and resulting interests and actions, storing cookies on your computer that record your usage behavior. If you have an account on the respective social media platform and are logged in, your usage behavior can even be stored across devices. Your usage profile can be used, for example, to place advertisements that presumably correspond to your interests.

We process personal data exclusively for communication with you via the social media platform you have chosen and to optimize our online presence, ensuring that no interests on your part are affected that outweigh our legitimate interest (Art. 6 I S. 1 f GDPR). If you have already given effective consent to the respective operator of the social media platform for the processing of your data, the processing of your personal data is also based on this consent (Art. 6 I S. 1 a GDPR).

5. Third-Party Services

5.1 Google Analytics for Firebase

Our app and website use Google Analytics for Firebase, an analytics service provided by Google, operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). This service collects and stores data, from which usage profiles are created using pseudonyms. The created usage profiles are used to evaluate user behavior in order to design and improve the app according to user needs. Google Analytics for Firebase uses the advertising ID of the mobile device for this purpose. The information generated about your use of this app is usually transmitted to a Google server in the USA and stored there. Since we have enabled anonymization in this app, your IP address or advertising ID will be shortened by Google within the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address or advertising ID be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this app, Google will use this information to evaluate your use of the app, to compile reports on app activities, and to provide other services related to app usage and associated services to the app operator. The processed information may also be used together with other Google services, such as Google Analytics and Google marketing services. In this case, only pseudonymous information, such as the Android Advertising ID, is processed to identify users' mobile devices. The legal basis for processing is the consent you have given (Art. 6 I S. 1 a GDPR).

You can prevent the collection of data related to your use of the app (including your IP address) by Google Analytics for Firebase and the processing of this data by Google:

5.2 Social Media Links

We have our own social media pages on third-party providers that can be reached via links from our website and our app. By using the links, you will be directed to the respective websites of the third-party providers (e.g., Facebook, Twitter, Instagram). To avoid unnecessary data transfer, we recommend logging out of the respective third-party provider before using a corresponding link so that usage profiles may not be created by the third-party provider through the use of the link.

5.3 Twilio

We use a cloud communication platform from Twilio Ireland Limited, 25-28 North Wall Quay, Dublin 1, Ireland ("Twilio"). This allows communication functions to be performed within the app. The legal basis for processing is the consent you have given (Art. 6 I S. 1 a GDPR).
